If you would have asked me before this podcast, I would have went so hard against the Yes means Yes law. I thought we would be doing the world a disservice by appealing to the dudes who pretend that they do not know what rape is. I have never cared too much about a person’s intent. Just because they didn’t know it was rape didn’t mean shit to me, take your ass to jail. But you guys are right, there is a good chance that some people will learn from this. And at this point, I for anything that could help. I think the larger issue is that they need to stop letting universities have any jurisdiction when it comes to rape accusations. Universities have too much of an incentive to keeping that rape statistics low at their institution. You guys have reported on many stories when the University have mistreated the women or given them to advice to not report.
One thing that will be tricky is how explicit the consent has to be. Because I’m sure I have never explicitly asked a woman “do you want to have sex with me.” But there is no question that all of the woman were willing and consenting of the act.
